ORDINANCE No. 946 <br />By Mr. Sloatt <br />pN ORDINANCE DETERMINING TO PROCEED WSTH THE IMPROVEMENT <br />OF lANDER ROAD IN THE.VILLAGE OF MAYFIELD, OHIO, BY , <br />GRADINGO DRAINING,_CURBING, PAVING, (.INCLUDING CURB <br />CONNECTIONS WHFRE NECL+SSARY) AND INSTAI.I.ING SIDEWAI.KS, <br />TOGETHER WITH ALL NECESSARY_APPURTENANCES, AND,DECLARING <br />AN LSERGhPICY. <br />BE IT ORDAINED BY THE CDUNCIL OF THE VILT,AGE OF MAYFIEI.D, OHIO, COUNTY OF <br />CUYt1HOGA,AND STATE OF OHIO, _THAT: <br />Sec. 1. It is hereby determined to proceed with the improvement in the <br />Village of riayfield, Ohio, of I,ander Road, from Wilson Mills Road Southerly <br />to the South corporation line of the Villages of Mayfield and Highland Heights <br />Ohio, by grading, draining, curbing, paving ( including curb connections where <br />necessary) and installing sidewalks, together with all necessary appurtenances. <br />Sec. 2. Said improvement shall be made in accordance with the provisions <br />of Resolution No. 666, adopted January 17, 1966, and with the plans, specifications, <br />estimates and profiles filed with this Council by the County Engineer of Cuyahoga <br />County and approved by the Village Engineer, by grading, draining, curbing, paving <br />(including curb connections where necessary) and installing sidewalks, together <br />with all necessary appurtenances, said improvement being made in cooperatiott <br />with the County of Cuyahoga and the Municipalities of Highland Ve.ights;riay£ield_Heights, <br />and Pepper Pike, in accordance with Ordinance No. 892., passed May 17, 1965. <br />Sec. 3, ,All claims for damages'resulting therefrom that have been legally <br />filed shall be enquired into before the commencement of the proposed improvement <br />and the Solicitor is hereby authorized and directed to institute legal proceedittgs <br />in a court of competent jurisdiction to en8uire into any claims that have been <br />so filed. <br />Sec. 4. That portion of the cost provided in the above mentioned resolution <br />of necessity to be assessed shall be assessed in the manner provided in said <br />resolution on the lots and lands described therein but in 20 annual installments, <br />otherwise in all respects as set forth in said Resolution. <br />Sec. 5. The estimated assessments heretofore prepared and filed in the <br />office of the Clerk of this Council are hereby adopted. <br />Sec. 6. The Clerk of this Council is hereby directed to deliver a <br />certified copy of this.ordinance to the County Auditor withitt 15 days after <br />the date of its passage. , <br />
