ORDINANCE No. 102;J <br />By Mr. Davis <br />AN ORDINANCfs DETERMINING TO PROCGED WITH THE TMPROVN2IENT <br />OF WORTON PARK DRIVE, FROM WILSON MIId.S ROAD TO HEMINGWAY <br />ROAD, BY GRADING AND PAVING WITH ASPNALTIC CONCRETE <br />MATERIALS, TOGETHER WITH AI,L NECSSSARY APPURTENANCES, <br />AND DECLARING AN EMERGENCY <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, COUNTY OF' <br />CUYAHOGA, STATS OF OHIO, THAT: ' <br />Sec. 1, it is hereby determined to proceed with the improvement in <br />the Village of Mayfield, Ohio, of Worton Park Drive, from Wilson Mills <br />Road to Hemingway Road, by grading and paving with asphaltic concrete <br />materials, together with all necessary appurtenances. <br />Sec. 2. Said improvement shall be made in accordance with the <br />provisions of Resolution No. 704, adopted March 20, 1967, and with the <br />plans, specifications, estimates of cost and profiles hitherto filed with <br />this Council by the Village Engineer,,by grading and paviag with asphaltic <br />f cottcrete materials, together with all necessary appurtenances. <br />! <br />Sec. 3. All claims for damages resulting therefrom that have been <br />legally filed shall be enquired into before the commencement of the proposed <br />improvement and the Solicitor is hereby authorized and directed to institute <br />legal proceedings in a court of competent jurisdiction to enquire into any <br />claims that have been so filed. <br />Sec. 4. That portion of the cost provided in the above mentioned <br />resolution o£ necessity to be assessed shall be assessed in the manner <br />provided in said resolution on the lots and lands described therein, in <br />ten (10) annual installments. <br />Sec. 5. The estimated assessments heretofore prepared and filed in <br />the office of the Clerk-Treasurer of this Council are hereby adopted. <br />Sec. 6. The Clerk-Treasurer of this Council is hereby directed to <br />deliver a certified copy of this ordinance to the County Auditor within 15 <br />days after the date of its passage. <br />Sec. 7. Subject to the provisians of Section 727.24 of the Ohio <br />Revised Code, the Mayor and the Clerk of the Village are hereby authorized <br />and directed as soon as the funds therefor are available to make and execute <br />a contract for said improvement with the lowest and best bidder after <br />advertising according to law and the improvement shall be financed as <br />provided in the resolution of necessity.
