ORDINANCE NO. 2008-01 <br />PAGE 2 <br />Section 3: The Clerk of Council shall promptly notify affected video service <br />providers of this Ordinance pursuant to R.C. 1332.32(B)(2)(g) which shall not take effect until <br />the first day of the first calendar quarter that begins 30 days after the notice is provided. The <br />Clerk of Council is further instructed to provide written notice to the video service provider of <br />the five percent (5%) franchise fee percentage under 1332.32(C)(1)(b) within 10 days after the <br />Village receives notice from the video service provider as required by Division (A) of Section <br />1332.27 of the Revised Code that the video service provider will commence to provide access to <br />video service in the Village. <br />Section 4: The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting in such formal action, took <br />place in meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />Section 5: This Ordinance is hereby declared to be an emergency measure immediately <br />necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio.
