ORDINANCE NO. 2008-21 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT FOR THE RENOVATION OF RALEIGH DRIVE, BETA DRIVE, AND WILSON MILLS ROAD. WHEREAS, it has been deemed necessary and in the best interest of the health, safety and welfare of all Village residents to renovate Raleigh Drive, Beta Drive, and Wilson Mills Road; and WHEREAS, pursuant to law, bids were advertised by the Village, those bids were received and reviewed and it was determined that the following company was the lowest responsive and responsible bidder for the project: Raleigh Drive Realignment and Wilson Mills Road Culvert #9 Replacement C.A. Agresta Construction Company Over Beecher's Srook NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor is authorized and directed to enter into a contract with C.A. Agresta Construction Company for the renovation of Raleigh Drive, Beta Drive and Wilson Mills Road, pursuant to the bids and specifications as advertised by the Village, and pursuant to that company's bid as follows: Raleigh Drive Realignment and Wilson Mills Road Culvert #9 Replacement Over C.A. Agresta Construction Company $344,777.22 Beecher's Brook which is determined to be the lowest responsive and responsible bid, the best bid, and pursuant to the terms and conditions as set forth in these documents, which shall be maintained by the Director of Finance. Notwithstanding, the Mayor shall not enter into this contract until the Village receives a Notice To Proceed from the Ohio Public Works Commission which is anticipated to be received on or about the week of July 7th, 2008. SECTION 2. The Village has conducted a certified search of the Findings for Recovery Database on the Ohio Auditor of State website, and the proposed vendor named herein is not listed therein.
