ORDINANCE N0.2008-31 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />DIRECTING THE MAYOR TO ENTER INTO AN <br />AFFILIATE COOPERATIVE PURCHASING AGREEMENT <br />WITH THE NORTHEAST OHIO SOURCING OFFICE ("NEO/SO"). <br />WHEREAS, NEO/SO was formed, in part, for the purpose of operating as a collective <br />purchasing and service organization to enable affiliates such as Mayfield Village and other similarly <br />situated entities to obtain competitive terms from vendors and service providers by utilizing the <br />combined purchasing power of all NEO/SO members and affiliates; and <br />WHEREAS, NEO/SO conducts competitive bidding and selection processes, and enters into <br />master contracts with selected suppliers to provide affiliates with certain group purchasing <br />opportunities for products, services, and back office functions, including the purchase of bulk road <br />salt; and <br />WHEREAS, these master contracts are made available through NEO/SO to participating <br />entities such as Mayfield Village so that such parties may participate in the offerings on the same <br />pricing, terms and conditions, in accordance with the applicable state and local laws and regulations; <br />and <br />WHEREAS, the Village desires to become an affiliate and enter into an Affiliate <br />Cooperative Purchasing Agreement with NEO/SO so as to afford it the opportunity to utilize <br />NEO/SO's master contract and access offerings such as its Bulk Road Salt Program. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE <br />OF MAYFIELD, COUNTY OF CUYAHOGA (the "Entity") AND STATE OF OHIO THAT: <br />SECTION 1. Authorization to Participate in NEO/SO Bulk Salt Program. The Mayor <br />is authorized and directed to negotiate and enter into an Affiliate Cooperative Purchasing Agreement <br />with NEO/SO in the form attached hereto and incorporated herein by reference as Exhibit "A". <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />~_ <br />~.. <br />
