ORDINANCE NO. 2008-35 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR <br />TO ENTER INTO AN AGREEMENT WITH THE <br />NORTHEAST OHIO AREAWIDE COORDINATING AGENCY (NOACA) <br />FOR THE USE OF FUNDS RECEIVED THROUGH THE <br />TRANSPORTATION FOR LIVABLE COMMUNITIES INITIATIVE (TLCI) <br />PLANNING GRANT TO PROMOTE HIKE AND BIKE TRAILS <br />THROUGHOUT THE VILLAGE <br />AND ESTABLISH THE GREENWAY CORRIDOR MASTERPLAN <br />WHEREAS, in 2007 pursuant to Resolution No.2007-12, Village Council authorized <br />the Mayor and Director of Finance to file an application with NOACA for the use of funds <br />through the TLCI Planning Grant to promote Hike and Bike Trails throughout the Village; and <br />WHEREAS, the application was approved by NOACA and in accordance with the <br />provisions of the Grant, the Village is required to authorize and enter into an agreement with <br />NOACA outlining the scope of the goals of the TLCI and the development of a comprehensive <br />Greenway Corridor Master Plan; and <br />WHEREAS, pursuant to the provisions of the TLCI Planning Grant the Village agrees <br />to enter into an Agreement with NOACO and use the funds received to generally evaluate <br />transportation and pedestrian linkages in the Village, to further evaluate the proposed location <br />of hike and bike trails in the Village and confirm the Village's commitment of a 20% match of <br />funds awarded. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor is hereby and herein authorized and directed to enter into an <br />agreement with NOACA in a form substantially similar to and based upon the terms and <br />conditions outlined in Exhibit "A" attached hereto and incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield Village, <br />Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of <br />
