and release the mortgage above-referenced and any balance remaining to be paid directly to the <br />Seller; and <br />c. Cln or about December 31, 2010, the sum of Forty-Six Thousand Six <br />Hundred Dollars ($46,600.00) payable directly to the Seller. <br />Such price shall be contingent upon Village Council's approval. <br />2. THE PREMISES. The purchase price of the premises and personal <br />property shall include: t'he premises, the building and improvements therein, all fixtures, <br />specifically but not limited to all electrical, heating, plumbing and bathroom fixtures, all light <br />bulbs, landscaping, window and door shades and coverings, screen and storm windows, all <br />curtains, drapes and rods, all hanging lighting fixtures, all tacked-down carpeting, any built in <br />bookcases and cabinets, stove and/or oven, kitchen appliances and all attached mirrors and <br />storage cabinets. <br />3. POSSESSIOIlT. Buyer shall be entitled to take title of said premises as of the date <br />set for the closing of this matter. However, Seller may remain in possession of the property for <br />up to one (1) year from January 1, 2009. Buyer shall be entitled to take possession of the said <br />premises at the end of the one (1) year, or earlier if the parties so agree in writing, from the date <br />of transfer of title. Seller agrees to enter into a written Lease Agreement, prior to the date of <br />transfer of title, with the Village in accordance with the terms outlined herein in a form similar to <br />that attached hereto as Exhibit "B". The Lease shall be free of rent for one year. <br />Buyer and Seller shall cooperate to have any and all utilities transferred as of the date <br />Seller is no longer in possession and Seller shall order final meter readings as of said date. <br />4.
