RESOLU'I'ION NO. 2015-05 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL <br />TO ENTER INTO A MEMORANDUM OF UNDERSTANDING <br />WITH TI3E CUYAHOGA SOIL AND WATER CONSERVATION DISTRICT <br />FOR PROVIDING TECHNICAL ASSISTANCE IN <br />IMPLEMENTING SOIL AND WATER CONSERVATION MEASURES <br />WHEREAS, it is the expressed desire of Mayfield Village to enter into a Memorandum of <br />Understanding with the Cuyahoga Soil and Water Conservation District to provide technical <br />assistance in implementing soil and water conservation measures; <br />WHEREAS, this Memorandum of Understanding facilitates solutions to problems <br />encountered by the Village as it plans for the development/redevelopment and conservation of its <br />environment, as well as water quality improvements; and <br />WHEREAS, this Memorandum of Understanding describes the process for collaboration <br />between the parties in carrying out mandated responsibilities, especially related to the Minimum <br />Control Measures for the National Pollutant Discharge Elimination System (NPDES) for Storm <br />Water as defined in Ohio Revised Code Section 3745-39-04(B)(1) through (6). <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. Council hereby authorizes the Mayor and Pres'ident of Council to enter into a <br />Memorandum of Understanding with the Cuyahoga Soil and Water Conservation District for <br />providing technical assistance in implementing soil and water conservation measures attached hereto <br />and incorporated herein by reference as Exhibit "A". <br />SECTION 2. The Council finds and determines that all formal actions of the Council <br />relating to the adoption of this Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting in such formal action, took <br />place in meetings open to the public in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Resolution is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the health, safety and welfare of the residents of Mayfield Village. It
