RESOLUTION NO. 2015-12 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />AUTHORIZING THE DISPOSITION OF CERTAIN MUNICIPAL PROPERTY <br />BY THE FIRE DEPARTMENT OF THE VILLAGE OF MAYFIELD <br />WHEREAS, the Fire Deparhnent of the Village of Mayfield is in possession of certain property <br />owned by the Village that is no longer needed for public use, or is obsolete or unfit for the use for which it <br />was acquired; and <br />WHEREAS, Section 721.15 of the Ohio Revised Code requires the disposition of personal <br />municipal property to be authorized by the legislative authority of the municipal corporation; and <br />WHEREAS, Council deems it necessary and in the best interest to the health, safety and welfare <br />of all Village residents to dispose of such municipal property by authorizing the sale of such property by <br />internet auction. <br />NOW, THEREFORE, SE IT ORDAINED by the Council of the Village of Mayfield, County of <br />Cuyahoga and State of Ohio: <br />t <br />SECTION 1. Municipal property owned by the Village and currently in possession of the <br />Village Fire Department is itemized on the document attached as Exhibit "A." <br />SECTION 2. Upon review of the information provided by the Village Fire Department, Council <br />hereby determines that the property set forth in Exhibit A is municipal property that is no longer needed <br />for public use, or is obsolete or unfit for the use for which it was acquired, and authorizes the sale of such <br />property by internet auction. <br />SECTION 3. The sale of the property set forth in Exhibit A shall be conducted by the Chief of <br />the Village Fire Department through the internet auction site govdeals.com, as set forth in the document <br />attached as Exhibit "B." A minimum of ten (10) calendar days, including Saturdays, Sundays and legal <br />holidays, shall be allotted for bidding, and the property shall have minimum reserve pricing as set forth in <br />Exhibit "A". <br />SECTION 4. The Council finds and determines that all formal actions of the Council relating to <br />the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of <br />this Council and of its committees, resulting in such formal action, took place in meetings open to the <br />public in compliance with all statutory requirements including the requirements of Section 121.22 of the <br />Ohio Revised Code. <br />41 <br />U:',.COUNCIL\COUNCIL 201 5\RESOLUTIONSV 2- Fire department equipmen[.doc
