OHIO ENVIRONMENTAL PROTECTION AGENCY <br />SURFACE WATER IMPROVEMENT FUND. <br />GRANTAGREEMENT <br />Page 7 7 <br />the Department of Administrative Services. (The form may be completed with ari <br />electronic filing through the Ohio Business Gateway at http://business.ohio.gov/): <br />40. (Compliance) In the performance of the duties and obligations under this Agreement, <br />Subgrantee shall comply with all applicable: <br />a. Ohio Governor Executive Orders; <br />b. Federal, state and local laws, regulations (rules), assurances, orders, and Ohio. <br />Department of Commerce Prevailing Wage Guidelines,~regarding prevailing wages, <br />deductions, worker compensation, taxes, social security and unemployment, <br />compensation, and any contributions thereto; and <br />c. Federal state, and local laws and regulations (rules, ordinances), assurances, and <br />orders, whether or not specifically referenced herein. <br />40a. (Small and Minority Business, and Women's Business Enterprises) The <br />Subgrantee and subSubgrantees shall take all necessary affirmative steps to assure that, <br />minority firms, women's business enterprises, and labor surplus area firms are used whan <br />possible. Affirmative steps shall include: <br />a. Placing qualified small and minority businesses and women's business enterprises <br />• ~ ~ on solicitation lists; <br />b. Assuring that small and minority businesses, and women's business enterprises are <br />solicited whenever they are potential sources; <br />c.. Dividing total requirements, when economically feasible, into smaller tasks or <br />quantities to permit maximum participation by small and minority business, and <br />women's business enterprises; . <br />d. Establishing delivery schedules, where the requirement permits, which encourage <br />participation by small and minority business, and women's business enterprises; <br />e. Using the services and assistance of the Small Business Administration, and tha <br />Minority Business Development Agency of the Department of Commerce; <br />f. Requiring that subSubgrantees, if subcontracts are to be let, take the affirmative <br />steps listed in this Paragraph; <br />g. Pursuant to Executive Order No. 2008-12S, Subgrantee and subSubgrantees, if any, <br />shall make a good faith effort to purchase from Ohio companies any goods and <br />services acquired under this Agreement; and <br />h. Pursuant to Executive Order No. 2008-13S, Subgrantee and subSubgrantees, if ~~any, <br />shall make a good faith effort to purchase goods and services from certified Minority <br />Business Enterprise ("MBE") and Encouraging Diversity, Growth and Equity <br />("EDGE") program vendors.
