OHIO ENVIRONMENTAL PROTECTION AGENCY <br />SURFACE WATER IMPROVEMENT FUND <br />GRANTAGREEMENT <br />Page 13 <br />said nonconformity to the Grant Coordinator in writing. Thereafter, such person(s) <br />shall not participate in any action affecting any work under this Agreement. <br />46. (Federal Assurances) By signing this Agreement, Subgrantee certifies that <br />Subgrantee will: <br />a. Comply if applicable, with flood insurance purchase requirements of Section 1 ov(a) <br />of the Flood Disaster Protection Act of 1973 (P L. 93-234) which requires recipients <br />in a special flood hazard area to participate in the program and to purchase flood <br />insurance under certain conditions; <br />b. Comply with environmental standards which may be prescribed pursuant to the <br />following: (i) institution of environmental quality control measures under the National <br />Environmental Policy Act of 1969 (P.L. 91-190) and Executive Order 11514; (ii) <br />notification of violating facilities pursuant to Executive Order 11738; (iii) protection of <br />wetlands pursuanf to Executive Order 11990; (iv) evaluation of flood hazards in flood <br />plains in accordance with Executive Order 11988; (v) assurance of project <br />consistency with the approved State management program developed under th~~ <br />Coastal Zone Management Act of 1972 (16 U.S.C. §§ 1451 et seq.); (vi) conforrriity <br />_ of Federal actions to State (Clean Air) Implementation Plans under Section 17~~c) of <br />the Clean Air Act of 1955, as amended (42 U.S.C. §§ 7401 of seq.); (vii) protection <br />•' - ~~ of underground sources of drinking water under the Safe Drinking Water Act of~ <br />1974, as amended (P.L. 93-523); and (viii) protection of endangered species under <br />the Endangered Species Act of 1973, as amended (P L. 93-205); <br />c. Comply with the Wild and Scenic Rivers Act of 1968 (16 U.S.C. §§ 1271 et seq:) <br />related to protecting components or potential components of the national wild and <br />scenic rivers systems; and <br />d. Assist Ohio EPA in assuring compliance with Section 106 of the National Historic <br />Preservation Act of 1966, as amended (16 U.S.C. § 470), Executive Order 115J3 <br />(identification and protection of historic properties) and the Archaeological and <br />Historic Preservation Act of 1974 (16 U.S.C. §§ 469a-1 et seq.) <br />47. (Mailing List) Subgrantee, shall include the Grant Coordinator on all project mailing lists <br />and mailings. <br />48. (Interest Accrual) <br />a. Subgrantee may deposit grant monies awarded under this Agreement in interest <br />bearing ornon-interest bearing accounts. Subgrantee shall document any interest <br />accrued on grant monies awarded under this Agreement, under the federal portion <br />of the quarterly Fiscal Report and fiscal portion of the Closing Reports required <br />under this Agreement. <br />b. Subgrantee shall promptly, but at least quarterly, remit to Ohio EPA any interest <br />accrued on grant monies awarded under this Agreement. The Subgrantee may <br />
