RESOLUTION N0.2014-22 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION DECLARING IT NECESSARY <br />TO LEVY A TAX IN EXCESS OF THE TEN MILL LIMITATION <br />AND ASKING FOR THE CURRENT TAX VALUATION TO BE CERTIFIED. <br />WHEREAS, the Council of Mayfield Village finds that the amount of taxes which may <br />be raised within the ten-mill limitation by raising the current tax duplicate will be insufficient to <br />provide an adequate amount for the necessary requirements of the Village and that it is necessary <br />to levy a tax in excess of that limitation for the purpose of current expenses; and <br />WHEREAS, in accordance with Division (B) of Section 5705.03 of the Revised Code, in <br />order to submit the question of a tax levy, this Council requests from the Cuyahoga County <br />Fiscal Officer a certificate of the total current tax valuation of the Village and the dollar amount <br />of revenue that would be generated by the levy; and <br />WHEREAS, in accordance with Division (B) of Section 5705.03 of the Revised Code, a <br />certified copy of a resolution of this Council declaring the necessity of the tax, stating its <br />purpose, stating whether it is an additional levy, a renewal levy, or a replacement of an existing <br />levy, noting the Section of the Revised Code, pursuant to which its submission to the electors is <br />authorized, and requesting county fiscal officer certification of the total current tax valuation of <br />the Village and the dollar amount of revenue that would be generated by the proposed levy, will <br />be submitted to the county fiscal officer. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. This Council declares that it is necessary to levy a renewal tax in the <br />amount of 2.3 mills outside the 10-mill limitation for the purpose of current expenses, in <br />accordance with Division A of Section 5705.19 of the Revised Code and that it intends to submit <br />the question of the renewal tax levy to the electors at an election of November 4, 2014, as <br />authorized by Section 5705.19 and 5705.191 of the Revised Code. <br />SECTION 2. That Council shall request and receive from the Cuyahoga County Fiscal <br />Officer a certificate of both (1) the total tax valuation of the Village; and (2) the dollar amount of <br />revenue that will be generated by the 2.3 mill renewal levy specified in Section 1. <br />SECTION 3. The Clerk of Council is authorized and directed to deliver promptly to the <br />Cuyahoga County Fiscal Officer a certified copy of this resolution and in order to obtain the <br />information necessary to submit the within proposed renewal tax levy to the Board of Elections <br />by the deadline for the submission of ballot issues to be submitted to the electors of the Village at <br />the general election to be held on November 4, 2014. <br />SECTION 4. The Council finds and determines that all formal actions of the Council <br />relating to the adoption of this Resolution have been taken at open meetings of this Council; and <br />
