RESOLUTION NO. 2010-11 ~ <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />AUTHORIZING THE MAYOR TO PREPARE AND SUBMIT AN <br />APPLICATION TO PARTICIPATE IN THE <br />CUYAHOGA COUNTY MUNICIPAL ENERGY PROGRAM (MEP) <br />AND TO EXECUTE CONTRACTS AS REQUIRED <br />WHEREAS, the MEP Program will provide financial assistance to political subdivisions <br />to institute energy efficiency and conservation saving projects; and <br />WHEREAS, Mayfield Village is planning to improve the energy efficiency of its <br />municipally-owned buildings and institute energy conservation measures; and <br />WHEREAS, the energy improvements consist of doing an energy audit of all municipally- <br />ownedbuildings or implementation of a project that will reduce energy costs and improve energy <br />efficiency as described in the attached application, and is considered to be a priority need for the <br />community. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor is hereby and herein authorized to apply to the Cuyahoga <br />County Municipal Energy Conservation Program funds as described above. <br />SECTION 2. The Mayor understands funding for the MEP Program is provided by the <br />United States Department of Energy under the Energy Efficiency and Conservation Block Grant <br />(EECBG) Program administered by the Office of Energy Efficiency and Renewable Energy <br />within the U.S. Department of Energy. EECBG is authorized under Title V, Subtitle E of the <br />Energy Independence and Security Act of 2007 (EISA) and effective December 19, 2007 as <br />Public Law 110-140, and is funded effective February 2009 under the American Recovery and <br />Reinvestment Act (ARRA). Therefore, the Applicant hereby agrees to abide by all applicable <br />federal and state laws, federal and state statutory and regulatory requirements, Executive Orders <br />and Office of Management and Budget Circulars. Any Consultant agrees to comply with any <br />requirements imposed upon it under the aforementioned laws, regulations, Orders and Circulars. <br />SECTION 3. The Mayor is further authorized to enter into any agreements as maybe <br />necessary and appropriate for obtaining this financial assistance. <br />SECTION 4. The Council finds and determines that all formal actions of the Council <br />relating to the adoption of this Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting in such forrrial action, took place <br />
