ORDINANCE NO. 2002-06 , <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE CONSENTING TO AND DIRECTING <br />THE OHIO DEPARTMENT OF TRANSPORTATION BY <br />AND THROUGH ITS DIRECTOR OF TRANSPORTATION <br />TO CONSTRUCT FACE TO FACE CURB SURFACE TREATMENTS <br />TO SOM CENTER ROAD FROM THE SOUTH CORPORATION LINE <br />TO WILSON IVIILLS ROAD <br />WHEREAS, the Village has identified the need for and proposes the improvement <br />of the public highway which is described as follows: <br />Applying a face to face of curb surface treatment to SOM Center Road (SR-91) from <br />the South corporation line to Wilson Mills Road in the Village, a total of 0.53 miles more or <br />less. This work is part of a larger project involving the City of Mayfield Heights; and <br />WHEREAS, said portion of highway is within the municipal corporation limits of the <br />Village. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. It is declared to be in the public interest that the consent of the Village <br />be and such consent is hereby given to the Director of Transportation to construct the <br />above described improvements, in accordance with plans, specifications and estimates as <br />approved by the Director. <br />SECTION 2. The Village hereby requests the cooperation of the Director of <br />Transportation in the cost of the above described improvement as follows: <br />The entire cost and expense of the improvement will be provided by the State. No <br />participation is required by the Village. However, the Village shall install and/or repair all <br />curb ramps which are necessary to ensure compliance with the Americans with Disabilities <br />Act and the Village agrees to assume and bear 100% of the cost of such installation and/or <br />repair of curb ramps. Further, the Village agrees to assume and contribute 100% of the <br />cost of any work to be included in the construction contract, at the request of the Village, <br />which is determined by the Director not to be part of or made necessary by the <br />improvement. <br />SECTION 3. The Village `agrees that all right-of-way required for the described <br />project will be acquired and/or made available in accordance with current State and Federal <br />regulations. The Village also understands that right-of-way costs include eligible utility <br />costs. The Village agrees that all utility accommodation, relocation and reimbursement will <br />comply with current provisions of 23 CFR 645 in the ODOT Utilities manual. The Village <br />acknowledges that all right-of-way required for the project has been acquired and/or has <br />been made available. The Village shall maintain the right-of-way and keep it free from <br />obstructions, and hold said right-of-way inviolate for public highway purposes.
