ORDINANCE NO. 2002-06 , INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE CONSENTING TO AND DIRECTING THE OHIO DEPARTMENT OF TRANSPORTATION BY AND THROUGH ITS DIRECTOR OF TRANSPORTATION TO CONSTRUCT FACE TO FACE CURB SURFACE TREATMENTS TO SOM CENTER ROAD FROM THE SOUTH CORPORATION LINE TO WILSON IVIILLS ROAD WHEREAS, the Village has identified the need for and proposes the improvement of the public highway which is described as follows: Applying a face to face of curb surface treatment to SOM Center Road (SR-91) from the South corporation line to Wilson Mills Road in the Village, a total of 0.53 miles more or less. This work is part of a larger project involving the City of Mayfield Heights; and WHEREAS, said portion of highway is within the municipal corporation limits of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. It is declared to be in the public interest that the consent of the Village be and such consent is hereby given to the Director of Transportation to construct the above described improvements, in accordance with plans, specifications and estimates as approved by the Director. SECTION 2. The Village hereby requests the cooperation of the Director of Transportation in the cost of the above described improvement as follows: The entire cost and expense of the improvement will be provided by the State. No participation is required by the Village. However, the Village shall install and/or repair all curb ramps which are necessary to ensure compliance with the Americans with Disabilities Act and the Village agrees to assume and bear 100% of the cost of such installation and/or repair of curb ramps. Further, the Village agrees to assume and contribute 100% of the cost of any work to be included in the construction contract, at the request of the Village, which is determined by the Director not to be part of or made necessary by the improvement. SECTION 3. The Village `agrees that all right-of-way required for the described project will be acquired and/or made available in accordance with current State and Federal regulations. The Village also understands that right-of-way costs include eligible utility costs. The Village agrees that all utility accommodation, relocation and reimbursement will comply with current provisions of 23 CFR 645 in the ODOT Utilities manual. The Village acknowledges that all right-of-way required for the project has been acquired and/or has been made available. The Village shall maintain the right-of-way and keep it free from obstructions, and hold said right-of-way inviolate for public highway purposes.
