On any lot in a U-1 or U-2 Use District, not more than two commercial <br />vehicles or two trucks not exceeding one and one-half tons in rated <br />capacity each, may be parked in a covered and closed garage or out <br />of sight, provided the trucks or commercial vehicles are used solely by <br />occupants of the premises; . <br />(7.) The owner, owners or occupants of any building or premises or part <br />thereof where anything in viofation of this section is placed or exists, <br />and any person, firm or corporation who violafies any provision of this <br />section or fails to comply therewith, or whoever parks, stores or keeps <br />any vehicle upon any residentiaf premises, including Class U-1, Class <br />. U-2, Class U-3 and Ulass U-3AA tJse Districts, in violation of this <br />section, shaif for each and every violafiion or non-compliance be <br />deemed guilty of a misdemeanor, and upon conviction thereof shall be <br />subject to the penalty provided in Section 1149.99. <br />B. Commercial Vehicie for the ur oses of this cha ter shall mean an <br />automobile, van pick-u truck s ort utilit vehicle or similar vehicle <br />that is used for commercial business or manufacturinq purpases <br />Mounted equipment, signs racks carrying equipment, tools, ladders, <br />materia( and similar items are considered to exhibit prima-facie <br />evidence of a commerc;ial vehicle C. Truck for the purposes of this cha ter shall include an ick-u truck <br />anv truck one and one-half tons in rated capacitv or more van sport <br />utilitv vehicle, tractor, semi-trailer, or trailer used for commercial <br />business, or manufacturing purposes. <br />SECTlON 2. That the amendment to Section 1157.07 as set forth in new Sections <br />(B) and (C) set forth above shall be enforceable commencing July 1, 2002. <br />SECTION 3. The Council finds and determines thatall formal actions ofthis Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Counci{ and of its committees, resuiting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code.
