ORDINANCE NO. 2002- 07 <br />PAGE TWO <br />customarily incident to the operation of any apartment house, hotel or <br />motel situated on the premises; <br />(6.) On any lot in a U-1 or U-2 Use District, not more than two commercial <br />vehicles or two trucks not exceeding one and one-half tons in rated <br />capacity each, may be parked in a covered and closed garage or out <br />of sight, provided the trucks or commercial vehicles are used solely by <br />occupants of the premises; <br />(7.) The owner, owners or occupants of any building or premises or part <br />thereof where anything in violation of this section is placed or exists, <br />and any person, firm or corporation who violates any provision of this <br />section or fails to comply therewith, or whoever parks, stores or keeps <br />any vehicle upon any residential premises, including Class U-1, Class <br />U-2, Class U-3 and Class U-3AA Use Districts, in violation of this <br />section, shall for each and every violation or non-compliance be <br />deemed guilty of a misdemeanor, and upon conviction thereof shall be <br />subject to the penalty provided in Section 1149.99. <br />B. Commercial Vehicle for the purposes of this chapter shall mean anv <br />automobile van pick-up truck, sport utility vehicle, or similar vehicle <br />that is used for commercial, business or manufacturing purposes. <br />Mounted equipment signs, racks carrying equipment, tools, ladders, <br />material and similar items are considered to exhibit prima-facie <br />evidence of a commercial vehicle. <br />C. Truck for the purposes of this chapter shall include any pick-up truck, <br />any truck one and one-half tons in rated capacity, or more, van, sport <br />utility vehicle tractor, semi-trailer, or trailer used for commercial, <br />business, or manufacturing purposes. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law.
