J <br />ORDINANCE NO. 2002- 12 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE ACCEPTING THE GRANT <br />OF A WATER LINE EASEMENT FROM THE <br />CLEVELAND ELECTRIC ILLUMINATING COMPANY <br />TO THE VILLAGE OF MAYFIELD <br />WHEREAS, the Village of Mayfield has been proceeding with the widening of S.O.M. <br />Center Road, between Wilson Mills Road north to White Road; and <br />WHEREAS, in conjunction with this project a certain water line must be relocated <br />requiring the granting of an easement by the Cleveland Electric Illuminating Company to <br />the Village of Mayfield over land which the water line will be constructed; and <br />WHEREAS, the Village of Mayfield desires to accept the grant of such easement <br />from the Cleveland Electric Illuminating Company to the Village. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Village of Mayfield hereby accepts the grant of a water line <br />easement from the Cleveland Electric Illuminating Company over land upon which a water <br />line will be constructed as more fully described in Exhibit "A" attached hereto and <br />incorporated herein by reference. <br />SECTION 2. Further, the Mayor has authorized and directed and ekecute <br />acceptance of this water line easement and thereafter, take the necessary steps for <br />recordation thereof. SECTION 3. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />?-- <br />? <br />WILLIAM BUCKHOLTZ <br />Council President
