Grantee, by exercising the rights herein granted, agrees that all trenches shall be backfilled with goad, clean fill dirt, well compacted, and the area restored to a condition to conform wiih the remainder of Grantor's premises and to substantially the same condition, including seeding, that existed prior to excavation and that the surface thereof i shall be on the same grade as adjacent lands. Grantee or its agents shall at all times maintain with its equipment a minimum vertical clearance of twelve feet (12) from Grantor's °faciliGes and a horrzontal distance of ten feet (10) from all poles or anchors, and any excavations near a structure or-anchor shall incorporate methods to prevent soil strength reductions. Said water main ? shall be installed at least twenty (20) feet from eny electrical structure. In addition to the above ground structures, the ? underground cables of L-5-LA-L supplying the S.O.M. Campus of Progressive Insurance also occupy this property. Proper cable support and protection shall be provided tn this distribution circuitry by the Grantee, its contractors, successors and assigns. No above ground water main structures are permitted within the easement area. Seid water main shall be visibly marked by; a permanent marker in ihe field where said water main enters and leaves the Grantor's property along with another marker equidistant between the above-mentioned pofnts. Grantee is responsible for any and all expenses associated with reinforcing or holding of Grantor's facilities to allow construction and or repair of said water main, Grantee shall register said water main with the Ohio Utilities Protection Service. i Grantee will immediately repair, replace or pay for any and all damages of any kind whatsoever to Grantors premises and will pay, Grantor for any and all damages to Grantors facilities located on said premises ceused by or related to the installation, operating, maintenance, repair or removal of said water main. The design of said water ! main should incorporate the expectation that the Grantor will be using very heavy and large equipment on the premises. : If buried grounding wires are damaged during water main installation, said damage shall be immediate[y reported to the Grantor, i - 2 -
