J ORDINANCE NO. 2002- 13 -? INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE ACCEPTING THE DEDICATION PLAT OF A THIRTY FOOT WATER EASEMENT ACROSS PROPERTY OWNED BY THE CLEVELAND ELECTRIC ILLUMINATING COMPANY. WHEREAS, the Village of Mayfield has been proceeding with the widening of S.O.M. Center Road, between Wilson Mills Road, north to White Road; and WHEREAS, in conjunction with this project a new water line must be constructed over certain parcels owned by the Village of Mayfield, Mayfield Investment, Inc. and the Cleveland Electric Illuminating Company; and WHEREAS, the Village of Mayfield desires to accept the dedication plat of a thirty foot water easement for all purposes related or incidental thereto, over these parcels. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF, MAYFIELD VILLAGE, OHIO, THAT: --_ , SECTION 1. The Village of Mayfield hereby accepts the dedication plat of a thirty foot water line easement attached hereto at Exhibit "A", attached hereto and incorporated herein for all purposes related or incidental thereof to its use for the construction of a standard circulation water line easement as granted by the Cleveland Electric Illuminating Company. SECTION 2. Clerk of Council is instructed to endorse the acceptance upon the easement plat and record it in the office of the County Recorder of Cuyahoga County. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Co M.cil and approval by the Mayor or otherwise at the earliest time allowed by law. t - G _ WILLIAM BUCKHOLTZ ` Council President
