ORDINANCE NO. 2002-15 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE ACCEPTING THE <br />DEDICATION PLAT OF A THIRTY FOOT WATER EASEMENT <br />ACROSS VILLAGE OWNED PROPERTY. <br />WHEREAS, the Village of Mayfield has been proceeding with the widening of S.O.M. <br />Center Road, between Wilson Mills Road, North to White Road; and <br />WHEREAS, in conjunction with this project a new water line must be constructed <br />over certain parcels owned by the Village of Mayfield, Mayfield Investment, Inc., and the <br />Cleveland Electric Illuminating Company; and <br />WHEREAS, the Village of Mayfield desires to accept the dedication plat of a thirty <br />foot water easement for all purposes related or incidental thereto, over these parcels. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Village of Mayfield hereby accepts the dedication plat of a thirty <br />foot water line easement attached hereto at Exhibit "A", attached hereto and incorporated <br />herein for all purposes related or incidental to its use for the construction of a standard <br />circulation water line easement as granted by the Village of Mayfield. <br />SECTION 2. The Clerk of Council is instructed to endorse the acceptance upon the <br />easement plat and record it in the office of the County Recorder of Cuyahoga County. <br />SECTION 3. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law.- <br />/r? <br />WILLIAM BUCKHOLTZ <br />Council President <br />?_ ?/
