? ORDINANCE NO. 2002- 17 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE CREATING SECTION 141.08 OF THE CODIFIED ORDINANCES CONCERNING THE INVESTIGATION OF FIRES AND ARSONS. WHEREAS, Ohio Revised Code Section 737.27 states in part that the legislative authority of a municipal corporation may invest any officer of the Fire or Police Department with the power and impose on him the duty, to be present at all fires, investigate the cause thereof and perform all other acts necessary to the effective discharge of such duties; and WHEREAS, the establishment and appointment of fire investigators within the Village of Mayfield would increase public safety and therefore contribute to the health, safety and welfare of our residents and businesses. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. There is hereby and herein created new Section 141.08 of the Codified Ordinances, to read as follows: 141.08 FIRE/ ARSON INVESTIGATION. (a) An employee or employees within the Fire Department may be designated by the Fire Chief as "Fire Investigators" pursuant to Ohio Revised Code Section 737.27. (b) Such Fire Investigators shall investigate, or cause to be investigated, every fire or explosion occurring within the jurisdiction of Mayfield Village that is of a suspicious nature or which involves the loss of life or serious injury or causes destruction or damage to property. Such investigations may go outside the jurisdiction of Mayfield Village by mutual agreements with adjoining or regional communities. (c) Such fire investigators must receive the required training, and be duly sworn as a law enforcement officer, and shall have the power and duty to investigate the cause of all fires, examine witnesses, compel the attendance of witnesses, and the production of books and papers and to do and perform all other acts necessary to the effective discharge of such duties.
