ORDINANCE NO. 2002-18 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AUTHORIZING THE GRANT <br />OF AN EASEMENT FOR INGRESS AND EGRESS AND SIGN PURPOSES <br />FROM THE VILLAGE OF MAYFIELD TO GOVERNOR'S VILLAGE, LLC. <br />WHEREAS, the Village of Mayfield is the owner of certain parcels of real property <br />fronting along North Commons Boulevard, and known as being Permanent Parcel Numbers <br />831-05-135 and 831-05-44; and <br />WHEREAS, in order to allow ingress and egress to contiguous parcels of real estate <br />owned by Governor's Village, LLC an easement for such purposes has been requested; <br />and <br />WHEREAS, such easement shall include ingress and egress by vehicular and <br />pedestrian traffic, the installation, operation, maintenance, repair and replacement of utility <br />lines for water, storm sewer, sanitary sewer, electricity, gas, cable, telephone and other <br />utilities and for parking and for the installation, maintenance, lightening, landscaping, repair <br />and or placement of one identification sign for the Governor's Village parcels; and <br />WHEREAS, the Village of Mayfield desires to authorize and grant such easement <br />to Governor's Village, LLC. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Village of Mayfield hereby grants to Governor's Village an <br />easement for ingress and egress and for a sign easement area as more fully described in <br />Exhibit "A" attached hereto and incorporated herein by reference. <br />SECTION 2. Further, the Mayor is authorized and directed to execute the <br />acceptance of this easement and thereafter take the necessary steps for the recordation <br />thereof. <br />SECTION 3. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the
