ORDINANCE NO. 2002- 31 INTRODUCED BY: Mayor Rinker and Council as a Whole ,---, f AN EMERGENCY ORDINANCE AUTHORIZING AND APPROVING THE PURCHASE OF TWO THERMAL IMAGING CAMERAS FROM FINLEY FIRE IN AN AMOUNT NOT TO EXCEED $28,000.00 WITHOUT THE NECESSITY OF ADVERTISEMENT AND FORMAL BIDDING WHEREAS, Section 731.05 of the Ohio Revised Code provides that in the case of a real and present emergency arising in connection with the operation of any Municipal Department, the legislative authority may, by two-thirds vote of all of its members elected thereto, authorize a purchase without formal bidding and advertising; WHEREAS, it has been found that a real and present emergency exists for the Village Fire Department to be equipped with Thermal Imaging Cameras in order to maintain a Fire Department equipped with life saving technology to protect those in peril and the health, safety and welfare of Village residents; and WHEREAS, due to the existence of such real and present emergency, Village Council has determined that such purchase be made immediately and that the same be purchased from Finley Fire for an amount not to exceed Twenty-eight Thousand Dollars ($28,000.00) without the necessity of advertisement and formal bidding. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Council of the Village of Mayfield hereby authorizes and approves the purchase of two (2) Thermal Imaging Cameras from Finley Fire in an amount not to exceed Twenty-eight Thousand Dollars ($28,000.00) which was deemed the best price for equipment readily available without advertising and formal bidding due to the existence of a real and present emergency. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
