i - <br />RESIDENTIAL REAI, ESTATE PiJRCHASE AGREEIv[E1VT <br />1. OFFER; AGREEMENT. Mayfield Village (hereinafter called the "Buyer", whether one or <br />more) agrees to buy and Sandra Polz (hereinafter called the "Seller", whether one or more) hereby offers <br />aud agrees to sell the property described below. Tlus Offer shall be accepted upon Buyer signing and <br />deliveruig this Agreement to Seller (or Seller's attomey) on or before 5:00 p.m., October 10, 2002, (the <br />"Acceptance Dea,dl'uie"). Seller may witlidraw this Offer at any time prior to acceptance by Buyer. In any <br />event, this Offer shail be void if not accepted by Buyer, on or before the Acceptance Deadline. As used <br />herein the "date of this Agreement" shall mean the date of Buyer's acceptance, and "this Agreement" shall <br />inean this Offer, when accepted by Buyer. <br />2. THE PROPERTY. <br />Address: 6186 Wilson Mills Road, Mayfield Village, Ohio 44143 <br />Pemlanent parcel number: 831-33-004 as more fully described in the legal description attached <br />hereto as Exhibit "A". <br />11ie "Property" sha11 include the land described above, a11 easements, hereditaments, <br />appurtenances, a.ll bttildings and fixtures in their present condition, and all of the folIowing items as are <br />now in the property: electrical, heating, plumbing and bathroom fixtures; light bulbs; shades, blinds, <br />curtain rods and drapery hardware; awniugs, screens, screen doors, sCorm windows and storm doors; <br />landscaping; radiator covers; oven; range; built-in appliances; tacked down carpeting; garage door openers <br />and controls; attaclaed smoke and/or fire detectors and security systems; fireplace grates and screens; and <br />attached rnirrors. <br />3. PURCHASE PRICE. The price shall be Seventy Five Thousand Dollars ($75,000.00) (the <br />"Purchase Price"), to be paid as follows: <br />A. An earnest money deposit of Two Thousand Dollars ($2,000.00) (the "Deposit") in the <br />form of a check payable to Seller to be delivered with this offer to Seller and deposited in <br />escrow at its opening. <br />B. The balance of the purchase price to be paid into escrow prior to the time the deed is filed <br />for record_ <br />4. FINANCING CONTINGENCY. Buyer represents that Buyer has funds available to purchase the <br />Property. Buyer's obligations hereunder are not conditioned upon Buyer's obtaining financing. <br />5. CONDTTION OF TUE PROPERTY; DISCLOSURES. <br />A. Condition of the Propertv. <br />SELLER HAS ACQUIRED TITLE TO TI-E PROPERTY THIltOUGH <br />INHERITANCE. SELLER HAS NOT OCCUPIED THE PROPERTY AS A PERSONAL <br />RESIDENCE.
