RESOLUTION NO. 2003- 06 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />A RESOLUTION <br />RE-ESTABLISHING TERMS, CONDITIONS AND COMPENSATION <br />FOR THE SERVICES OF THE DIRECTOR OF LAW <br />AND DECLARING AN EMERGENCY <br />BE IT RES4LVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor's appointment of Joseph W. Diemert, Jr. as Director of <br />Law for Mayfield Village, Ohio is hereby confirmed, subject to the terms, conditions and <br />compensation hereinaftei established. <br />SECTION 2. The Director of Law of Mayfield Village, Ohio, sha11 be responsible <br />for the administration of all civil, municipal legal matters and shall perform all duties <br />specified by the Charter of Mayfield Village, Ohio with regard to the Director of Law and <br />by the statutes of the State of Ohio with regard to the duties of City Solicitors. The <br />Dixector of Law shall not be responsible, however, for the coaduct nor compensation of <br />the Municipal Prosecutor, who shall be segarately appointed, directed and compensated. <br />SECTION 3. The Director of Law shall persona.lly conduct or directly supervise <br />all activities for which he is responsible. In any event, attendance at meeti.ngs of Council <br />shall be the sole and exclusive responsibility of the Director of La.w except as hereinafter <br />sta.ted and all adversary litigation shall be directed by the Director of Law. In the event of <br />absence from meetings, or in the event of being unable to conduct litigation, the Director <br />of Law sha11 cause a11 services necessary to the Municipality to be rendered by a qualified <br />attomey, licensed to practice law in the State of Ohio and having municipal legal <br />experience, which services shall be rendered in accordance with a11 of the terms and <br />conditions of this Resolution. <br />SECTION 4. Effective January 1, 2003, and retroactive thereto, the charges to the <br />Municipality for services to be rendered by the Director of Law shall be as follows: <br />(a) For attendance at regular Council meeti.ngs, Council Caucuses <br />an.d the regular meeting of the Planning Commi.ssion, plus <br />such other meetings of Boards, Commissions and Council at <br />wluch the attendance of the Law Director is requested, not to <br />exceed two (2) meetings per month, as well as routine oral <br />conferences by telephone or at the Village Hall or in the <br />office of the Law Director with the Mayor or Members of <br />? ???
