Rinker and Council as a Whole <br />A RESOLLJTTC?N SiJPPQRTING THE BIZEAST CANCER PA.TIEIoIT <br />PROTECTIQN ACT OF 2003 AND DECLARING AN EMERGENCY <br />WHEREAS, the Breast Cancer Patient Protection Act of 2003 has proposed to amend the Public <br />Health Service Act and Employee Retirement Income Security Act of 1974 to require that group and <br />individual health insurance coverage and group health plans provide coverage for a minimum hospital <br />stay for mastectomies and lymph node dissections performed for the treatment of breast cancer; and <br />WHEYZEAS, the Breast Cancer Patient Protection Act of 2003 proposes to further amend the <br />Public Health Service Act to prohibit group health plans and health insurance issuers offering group <br />health insurance coverage, with regard to hospital stays in connection with breast cancer treatment, from <br />(1) covering less than 48 hours after mastectomies or requiring plan or issuer authorization for <br />prescribing any length of stay; and <br />WHEREAS, the Breast Cancer Patient Protection Act of 2003 proposes to further amend the <br />Public Health Service Act to prohibit: (1) denying eligibility, enrollment, or renewal to avoid these <br />requirements; (2) providing payments or rebates to women; (3) penalizing or providing incentives to <br />providers; and (4) applies the same requirements to issuers in the individual market. <br />NOW, THEREFORE, BE IT 12ESOLVED BY THE MAYOlt AND COUNCII, OF MAYFIELI3 <br />VII.LAGE, OHIO THAT: <br />Section 1. The Village of Mayfield hereby expresses its strong support to the President of the <br />United States and the United States Congress to take emergency actions and enact measures to respond <br />to the adoption of the Breast Cancer Patient Protection Act of 2003 to amend the Public Health Service <br />Act and Employee Retirement Income Security Act of 1974 to require that group and individual health <br />insurance coverage and group health plans provide coverage for a m;nimum hospital stay for <br />rnastectomies and lymph node dissections performed for the treatment of breast cancer. <br />Section 2. The Clerk of Council is hereby directed to forward a certified copy of this Resolution <br />immediately upon passage and approval to the offices of President George W. Bush, Vice President <br />Richard Cheney, State Majority Leader Bill Frist, Speaker Dennis Hastert, U.S. Senators Mike DeWine <br />and George Voinovich, U. S. Representatives Sherrod Brown, Dennis Kucinich, Steven LaTourette, <br />Stephanie Tubbs-Jones, Governor Robert Taft, each of the members of the Cuyahoga County delegation <br />in the Ohio Senate and Ohio House of Representatives, each of the mayors of the municipalities, villages, <br />and townships within Cuyahoga County. <br />Section 3.
