<br />ORDINANCE N0.2004-02 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AMENDING SECTION 303.08 <br />OF THE CODIFIED ORDINANCES RELATING TO THE IMPOUNDMENT <br />OF VEHICLES WITH OUTSTANDING CITATIONS <br />WHEREAS, current Section 303.08(a)(10) authorizes the impoundment of a vehicle with two <br />or more citations which have not been "responded to" as lawfully required; and <br />WHEREAS, it is determined that this language is capable of being misinterpreted and maybe <br />misleading for law enforcement officials. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That Section 303.08(a)(10) is hereby and herein amended to read as follows: <br />303.08 IMPOUNDING OF VEHICLES; REDEMPTION. <br />(a) Police officers are authorized to provide the removal of a vehicle under the following <br />circumstances: <br /> <br />(10) When any vehicle is found for which two or more citation tags for violations of this <br />Traffic Code have been issued and the owner or operator thereof has failed to pay or contest such <br />citation as lawfully required, and is located upon a public street or other property open to the <br />public for purposes of vehicular travel or parking. This section will not be applicable unless a <br />minimum if 2 citations are outstanding, the most recent of which is more than 30 days from the <br />date if issuance. <br /> <br />SECTION 2. The Council finds and determines that all formal actions of this Council relating <br />to the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />
