63 ~ Health Safety and Sanitation 521.10 <br />A. Establish a telephone number through which all complaints by <br />residents relating to violations of this section may be directed or <br />referred; <br />B. Require, while an establishment is undergoing otherwise mandated <br />inspections, a "self-certification" from the owner, manager, <br />operator or other person having control of such establishment that <br />all requirements of this section have been complied with. <br />C. For establishments found out of compliance with this section or <br />receiving repeated resident complaints the Fire Department shall: <br />1. Provide to the proprietor or employer a copy of the <br />provisions of this section and ..such advisory assistance to <br />rectify future violations as may be necessary to achieve <br />compliance with the provisions of this section. <br />2. Follow-up such investigation and advice with a written <br />directive explaining in detail the steps required in order to <br />achieve. future compliance with the provisions of this <br />section; and <br />3. If the violations do not cease following the expiration of a <br />reasonable period of time, request commencement of a <br />criminal proceeding by the Prosecutor, as may be <br />appropriate pursuant to the provisions of subsection (h) <br />hereof. <br />(j) Education. The Fire Department shall engage in a continuing program to inform <br />and clarify the purposes of this section to residents affected by it, and to guide proprietors and <br />employers in their compliance. <br />(k) Governmental Agency Cooperation. The Mayor shall annually request such <br />governmental and educational agencies having offices within the Municipality to establish local <br />operating procedures to cooperate and comply with this section and shall urge enforcement of their <br />existing smoking restrictions. <br />(1) Relation to Other Law. This section shall not be interpreted or construed to permit <br />smoking where it is otherwise restricted by law, nor to relieve any proprietor, employer or other <br />responsible party from any liability resulting from exposure to tobacco smoke. <br />(m) Severability. If any provision, clause, sentence or paragraph of this section, or the <br />application thereof to any person or circumstances, shall beheld invalid, such invalidity shall not <br />affect the other provisions, or application of the provisions of this section which can be given <br />effect without the invalid provision, or application, and to this end the provisions of this section <br />are hereby declared to be severable. <br />(Ord. 86-7.
