513.12 GENERAL OFFENSES CODE 38 <br />513.11 HARMFUL INTOXICANTS; POSSESSING NITROUS OXIDE <br />IN MOTOR VEHICLE. <br />(a) As used in this section, "motor vehicle", "street" and "highway" have the same <br />meanings as in Ohio R.C. 4511.01. <br />(b) Unless authorized under Ohio R.C. Chapter 3719, 4715, 4729, 4731, 4741 or 4765, <br />no person shall possess an open cartridge of nitrous oxide in either of the following circumstances: <br />(1) While operating or being a passenger in or on a motor vehicle on a street, <br />highway, or other public or private property open to the public for purposes <br />of vehicular traffic or parking; <br />(2) While being in or on a stationary motor vehicle on a street, highway, or <br />other public or private property open to the public for purposes of vehicular <br />traffic or parking. <br />(c) Whoever violates this section is <br />vehicle, a misdemeanor of the fourth degree. <br />(ORC 2925.33) <br />guilty of possessing nitrous oxide in a motor <br />513.12 RESERVED. <br />(EDITOR'S NOTE: This section has been reserved for future legislation. <br />513.13 COUNTERFEIT CONTROLLED SUBSTANCES. <br />(a) No person shall knowingly possess any counterfeit controlled substance. <br />(b) Whoever violates this section .is guilty of possession of counterfeit controlled <br />substances, a misdemeanor of the first degree. <br />(ORC 2925.37; Ord. 96-26. Passed 8-5-96.) <br />513.14 ALLOCATION OF FINES IMPOSED FOR DRUG TRAFFICKING <br />AND RELATED ACTIVITIES. <br />(a) The Finance Director is hereby authorized and directed to establish a Special <br />Revenue Generic Fund Type which shall be known as the "Drug Law Enforcement Fund" . <br />Moneys from this Fund shall be used to subsidize the Police Department's efforts that pertain to <br />drug offenses. <br />(b) Whenever the Police Department is primarily responsible for or involved in making <br />the arrest of, and in prosecuting, any offender in violation of Ohio R.C. 2925.03, any mandatory <br />fine imposed pursuant to that section shall be accounted for in the "Drug Law Enforcement Fund" . <br />Any additional fine imposed pursuant to Ohio R.C. 2925.03(I) shall be disbursed as otherwise <br />provided by law. <br />(c) Whenever a person is charged with any violation of Ohio R.C. 2925.03 and forfeits <br />bail posted pursuant to Ohio R.C. 2937.22 and 2937.46 or Criminal Rule 46, the forfeited bail <br />shall be accounted for in the "Drug Law Enforcement Fund" . <br />(Ord. 89-44.
