~i <br />r-~-~ ORDINANCE NO. 2004-06 <br />\ _~ INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE REGARDING <br />THE POSSESSION OF CERTAIN WEAPONS IN PUBLIC PLACES <br />WHEREAS, upon recommendation of the Chief of Police, Mayor and Council deems <br />it in the best interest of the health, safety and welfare of all Village residents to amend <br />Chapter 549 of the Codified Ordinances so as to make it illegal to possess certain weapons <br />in public places. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Chapter 549 of the Codified Ordinances of Mayfield Village is amended <br />by adding new Section 549.11 as follows: <br />549.11 Carrying Unconcealed Weapons in Public Places <br />(a) No person shall knowingly carry unconcealed any firearm, handgun, <br />dangerous ordnance, shotgun, rifle, karate sticks, brass knuckles, <br />,- _, blackjacks, billyclubs, switchblade knives or knives having a blade <br />=~ l;, over two and one-half (2 '/2) inches in length, or any device or <br />instrument manufactured, fashioned or designed as a deadly weapon, <br />while at or about a public place. <br />(b) As used in this section "public place" means any place to which the <br />general public has access and a right to resort for business, <br />entertainment or other lawful purpose, but does not necessarily mean <br />a place devoted solely to the uses of the public. It also includes the <br />front or immediate area or any store, shop; restaurant, tavern or other <br />place of business and any grounds, areas or parks where persons <br />would congregate. <br />(c) A weapon described in subsection (a) hereof, carried unconcealed in <br />a public place in violation of this section, may be seized by the police <br />and may be returned or .disposed of by the Chief of Police in <br />accordance with the ordinances of the Village of Mayfield and the laws <br />of the State of Ohio. <br />(d) This section does not apply to officers, agents or employees of this or <br />any other state or the United States, or to law enforcement officers or <br />certified private security personnel authorized to carry weapons or <br />dangerous ordnance and acting within the scope of their duties. <br />-~ <br />s <br />t~.r.
