ORDINANCE NO. 2004-09 As Amended INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING AND GRANTING VARIOUS EASEMENTS TO THE EAST OHIO GAS COMPANY d/b/a DOMINION EAST OHIO AS AND FOR THE RELOCATION OF A GAS PIPE LINE IN CONNECTION WITH THE S.O.M. CENTER ROAD WIDENING PROJECT WHEREAS, the Village of Mayfield has been proceeding with the widening of S.O.M. Center Road, between Wilson Mills Road north to White Road; and WHEREAS, in conjunction with this project a certain gas line was relocated requiring the granting of various easements by the Village of Mayfield over land which the gas line was constructed; :and WHEREAS, the Village of Mayfield authorized the grant of such easements to the East Ohio Gas Company d/b/a Dominion East Ohio d/b/a Dominion East Ohio on October 21, 2002 pursuant to Ordinance No. 2002-38; and WHEREAS, the easements as granted were considered blanket easements and pursuant to the Village's agreement with Dominion East Ohio Gas, these blanket easements must be released and replaced with defined easements. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO THAT: SECTION 1. The Village of Mayfield hereby authorizes and grants to the East Ohio Gas Company d/b/a/ Dominion East Ohio various defined perpetual gas line easements for the construction, inspection, maintenance and repair of the gas line as more fully described in Exhibit "A" attached hereto and incorporated herein by reference. SECTION 2. The parcels over which the gas line easement is being authorized and granted are known as follows: Line List No. 1 Line List No. 2 Line List No. 3 Line List No. 4 Line List No. 5 Line List No. 6 Line List No. 13 Permanent Parcel No. 831-05-065 Permanent Parcel No. 831-07-003 and part of Permanent Parcel No. 831-05-065 Permanent Parcel No. 831-07-005 Permanent Parcel No. 831-07-006 Permanent Parcel No. 831-07-010 Permanent Parcel No. 831-07-008 Permanent Parcel No. 831-09-004
