If under the foregoing <br />circumstances, the employee has used four (4) earned tours during the calendar year, then said <br />employee shall be compensated at the end of the year for one (1) tour of pay without having any days <br />deducted from accumulated but unused sick leave. <br />When Employees, covered under this contact, and hired or rehired after January 1, 2000, have an <br />accumulation of twenty-one (21) tours unused sick leave and who, during the same calendar year, <br />have not used any of the sick leave days earned during that year shall be compensated at the end of the <br />calendar year the equivalent of fifty-six 56 hours pay without having any days deducted from <br />accumulated but unused sick leave. Sick leave accumulation lawfully transferred from prior public <br />shall be included for the purposes of this section. If under the foregoing circumstances, the employee <br />has used one (1) earned tour during the calendar year, then said employee shall be compensated at the <br />end of the year for forty-five 45 hours pay without having any days deducted from accumulated but <br />un}~sed sick leave. If under the foregoing circumstances, the employee has used two (2) earned tours <br />during the calendar year, then said employee shall be compensated at the end of the year for thirty- <br />four (34) hours pay without having any days deducted from accumulated but. unused sick leave. If <br />under the foregoing circumstances, the employee has used three (3) earned tours during the calendar <br />year, then said employee shall be compensated at the end of the year for twenty-three (23) hours pay <br />without having any days deducted from accumulated but unused sick leave. If under the foregoing <br />circumstances, the employee has used four (4) earned tours during the calendar year, then said <br />employee shall be compensated. at the end of the year for twelve (12) hours pay without having any <br />days deducted from accumulated but unused sick leave. <br />Section 22.11. Upon retirement or termination from service, all employees covered under this contract <br />shall be entitled to receive credit and payment for accumulated but unused sick leave not to exceed 960 <br />hours. For the purposes of this section, an employee shall be considered retired when such an <br />employee takes actions that are inconsistent with any reasonable intent to continue employment with <br />the Municipality. <br />Section 22.12. - In the event of an employee's death, all accrued sick leave up to a maximum of nine <br />hundred sixty (960) hours, shall be paid to the estate of the deceased employee. <br />ARTICLE 23 <br />FUNERAL LEAVE <br />Section 23.1. All employees shall be granted time off with pay for the purposes of attending the <br />funeral (1) tour of duty (24 hours) off for each death in the immediate family. The employee(s) <br />"immediate family" shall be defined as only including the employee's spouse, children, step-children, <br />parents, step-parents, brothers, sisters, grandparents, brothers/sisters-in-law. This time off will not be <br />used in the calculation of overtime pay or regarded as hours worked in that pay period. <br />Section 23.2. In the event the death occurs during the employee's work day, he shall be granted the <br />remaining portion of the day off with pay. Such time shall not be deducted from any of the employee's <br />leave credits. <br />Page 20 of 35 <br />
