If under the foregoing circumstances, the employee has used four (4) earned tours during the calendar year, then said employee shall be compensated at the end of the year for one (1) tour of pay without having any days deducted from accumulated but unused sick leave. When Employees, covered under this contact, and hired or rehired after January 1, 2000, have an accumulation of twenty-one (21) tours unused sick leave and who, during the same calendar year, have not used any of the sick leave days earned during that year shall be compensated at the end of the calendar year the equivalent of fifty-six 56 hours pay without having any days deducted from accumulated but unused sick leave. Sick leave accumulation lawfully transferred from prior public shall be included for the purposes of this section. If under the foregoing circumstances, the employee has used one (1) earned tour during the calendar year, then said employee shall be compensated at the end of the year for forty-five 45 hours pay without having any days deducted from accumulated but un}~sed sick leave. If under the foregoing circumstances, the employee has used two (2) earned tours during the calendar year, then said employee shall be compensated at the end of the year for thirty- four (34) hours pay without having any days deducted from accumulated but. unused sick leave. If under the foregoing circumstances, the employee has used three (3) earned tours during the calendar year, then said employee shall be compensated at the end of the year for twenty-three (23) hours pay without having any days deducted from accumulated but unused sick leave. If under the foregoing circumstances, the employee has used four (4) earned tours during the calendar year, then said employee shall be compensated. at the end of the year for twelve (12) hours pay without having any days deducted from accumulated but unused sick leave. Section 22.11. Upon retirement or termination from service, all employees covered under this contract shall be entitled to receive credit and payment for accumulated but unused sick leave not to exceed 960 hours. For the purposes of this section, an employee shall be considered retired when such an employee takes actions that are inconsistent with any reasonable intent to continue employment with the Municipality. Section 22.12. - In the event of an employee's death, all accrued sick leave up to a maximum of nine hundred sixty (960) hours, shall be paid to the estate of the deceased employee. ARTICLE 23 FUNERAL LEAVE Section 23.1. All employees shall be granted time off with pay for the purposes of attending the funeral (1) tour of duty (24 hours) off for each death in the immediate family. The employee(s) "immediate family" shall be defined as only including the employee's spouse, children, step-children, parents, step-parents, brothers, sisters, grandparents, brothers/sisters-in-law. This time off will not be used in the calculation of overtime pay or regarded as hours worked in that pay period. Section 23.2. In the event the death occurs during the employee's work day, he shall be granted the remaining portion of the day off with pay. Such time shall not be deducted from any of the employee's leave credits. Page 20 of 35
