ORDINANCE NO. 2004-13 (As Amended) INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE APPROVING A LOT SPLIT PLAT OF PROPERTY OWNED BY BME INVESTMENTS, LLC, AND KNOWN AS PERMANENT PARCEL NUMBER 831-27-007 AND PERMANENT PARCEL NUMBER 831-29-001 WHEREAS, the Planning Commission on February 2, 2004 approved the lot split plat relative to property owned by BME Investments, LLC, also commonly referred to as the Upper Forty and known as Permanent Parcel Number 831-27- 007 and Permanent Parcel Number 831-29-001; and WHEREAS, such lot split is deemed to be in the best interest of the Village and its residents. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO THAT: SECTION 1. The lot split plat as designated on the drawing only, attached ~, hereto and incorporated herein as Exhibit "A" and as submitted by John R. Alban ~ dated 12/29/03, for Permanent Parcel Number 831-27-007 and Permanent Parcel Number 831-29-001 is herein and hereby approved. SECTION 2. The Clerk is authorized to cause such Plat to be recorded with the appropriate public agencies as determined by the Village Engineer after the same is executed and approved by all appropriate officials and bodies. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
