ORDINANCE NO. 2004-13 (As Amended) <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />APPROVING A LOT SPLIT PLAT OF PROPERTY <br />OWNED BY BME INVESTMENTS, LLC, <br />AND KNOWN AS PERMANENT PARCEL NUMBER 831-27-007 AND <br />PERMANENT PARCEL NUMBER 831-29-001 <br />WHEREAS, the Planning Commission on February 2, 2004 approved the <br />lot split plat relative to property owned by BME Investments, LLC, also commonly <br />referred to as the Upper Forty and known as Permanent Parcel Number 831-27- <br />007 and Permanent Parcel Number 831-29-001; and <br />WHEREAS, such lot split is deemed to be in the best interest of the Village <br />and its residents. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO THAT: <br />SECTION 1. The lot split plat as designated on the drawing only, attached <br />~, hereto and incorporated herein as Exhibit "A" and as submitted by John R. Alban <br />~ dated 12/29/03, for Permanent Parcel Number 831-27-007 and Permanent Parcel <br />Number 831-29-001 is herein and hereby approved. <br />SECTION 2. The Clerk is authorized to cause such Plat to be recorded <br />with the appropriate public agencies as determined by the Village Engineer after <br />the same is executed and approved by all appropriate officials and bodies. <br />SECTION 3. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at open <br />meetings of this Council; and that deliberations of this Council and of its <br />committees, resulting in such formal action, took place in meetings open to the <br />public, in compliance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the health, safety and welfare of the residents <br />of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the <br />passage by the affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time allowed by <br />law. <br />
