<br />ORDINANCE N0.2004-14 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR <br />TO ENTER INTO A CONTRACT WITH J & J REFUSE <br />FOR RUBBISH PICK-UP AND OTHER MISCELLANEOUS ITEMS <br />FORA 39 MONTH PERIOD <br />WHEREAS, it has already been deemed necessary and in the best interest of the health, safety, <br />and welfare of all of the Village residents to have a rubbish pick-up program; and <br />WHEREAS, pursuant to law, bids were advertised by the Village, those bids were received, <br />and it was determined that the bid of J & J Refuse was the best bid. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, <br />OHIO THAT: <br />SECTION 1. The Mayor is authorized and directed to enter into a contract with J & J Refuse for <br />a 39 month period beginning April 12, 2004 through June 13, 2007, with an additional two year <br />option, with regard to rubbish pick-up and other miscellaneous items, pursuant to the bids and <br />specifications as advertised by the Village, and pursuant to that company's bid, as received by <br />the Village, which is determined to be the best bid, and pursuant to the terms and conditions as <br />set forth in these documents, which shall be maintained by the Director of Finance. <br />SECTION 2. The Council fmds and determines that all formal actions of this Council relating to <br />the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately <br />necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, <br />therefore, take effect immediately upon the passage by the affirmative vote of not less than five <br />(5) members elected to Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />l <br />WILLM BUCKHOLTZ <br />Council President <br />
