ORDINANCE NO. 2004-~s <br />~~_;' INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO A <br />MEMORANDUM OF UNDERSTANDING WITH THE <br />CUYAHOGA COUNTY DISTRICT BOARD OF HEALTH FOR SERVICES <br />RELATED TO THE VILLAGE'S <br />PHASE II STORM WATER ANNUAL REPORT TO THE OHIO EPA <br />WHEREAS, the Village has developed a Storm Water Management <br />Program to address the quality of storm water run off during and after soil <br />disturbing activities; and <br />WHEREAS, the Village adopted such plan pursuant to Ordinance No. 2003- <br />o'i ;and <br />WHEREAS, in order to facilitate the mandates of the program, the Village <br />finds it in the best interests of public health, safety and welfare to enter into a <br />Memorandum of Understanding with the Cuyahoga County District Board of <br />Health for services related to the identification and inspection of all Village outfalls <br />and for such information collected to be included within the Village's Phase II <br />Storm Water Annual Report to the Ohio EPA. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO THAT: <br />SECTION 1. The Mayor and President of Council are hereby authorized to <br />enter into a Memorandum of Understanding with the Cuyahoga County District <br />Board of Health for services related to the identification and inspection of all <br />Village outfalls including the provision of an annual summary to the Village for <br />inclusion in the Village's Phase Storm Water Annual Report to the Ohio EPA for an <br />amount not to exceed $5,300.00 and according to the terms and conditions as set <br />forth in Exhibit "A" attached hereto and incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at open <br />meetings of this Council; and that deliberations of this Council and of its <br />committees, resulting in such formal action, took place in meetings open to the <br />public, in compliance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />
