_~ ORDINANCE NO. 2004-25 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO JOIN WITH THE VILLAGE OF GATES MILLS AND THE GATES MILLS LAND CONSERVANCY AND THE CLEVELAND METROPARKS IN THEIR ISSUE 1 APPLICATION FOR ACQUISITION OF 10.3 ACRES IN HAYFIELD VILLAGE AND GATES MILLS WHEREAS, the Village is supportive of conserving natural resources in the Chagrin water shed; and WHEREAS, Permanent Parcel Nos. 831-27-007 and 841-13-006 comprise 4.5 acres in Mayfield Village and 5.8 acres in Gates Mills respectively; and WHEREAS, it has been determined that such parcels are intricately located within the Chagrin water shed, and adjacent to Metroparks' property, so as to be important for preservation and conservancy purposes. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD '+ VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized to join Gates Mills Village, the Gates Mills Land Conservancy, and/or the Cleveland Metroparks, in an Issue 1 Application to be filed for funding towards the purchase of the aforementioned parcels owned by BME Investments, LLC; and SECTION 2. That the Mayor is hereby and herein authorized and directed to enter into an agreement for the joint application for Issue 1 funds between the Village of Gates Mills, the Gates Mills Land Conservancy, and/or the Cleveland Metroparks, for the acquisition of 10.3 acres comprised of permanent parcel numbers as indicated above, and to contribute towards such successful Issue 1 Application the sum of Sixty Thousand Dollars ($60,000.00) with a contingency that the Village will have no fee ownership in such property or any specific liability for maintenance, upkeep, or development of same. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. ~,~
