.r \ ,~~ <br />i' ORDINANCE NO. 2004-27 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR TO ENTER <br />INTO A CONTRACT WITH ANSELMO'S LANDSCAPE & DESIGN <br />FOR VARIOUS DRAINAGE AND INFRASTRUCTURE PROJECTS <br />LOCATED IN THE VILLAGE OF MAYFIELD <br />IN AN AMOUNT NOT TO EXCEED $25,000.00 <br />WHEREAS, it has been deemed necessary and in the best interest of the <br />health, safety and welfare of all Village residents to engage in various drainage <br />and infrastructure projects located in the Village and identified on Exhibit "A" <br />attached hereto; and <br />WHEREAS, pursuant to law, bids were advertised by the Village, those bids <br />were received, and it was determined that the bid of Anselmo's Landscape & <br />Design was the best bid. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO THAT: <br />~`w SECTION 1. The Mayor is authorized to enter into a Contract with <br />~.~~ \ Anselmo's Landscape & Design to perform various drainage and infrastructure <br />projects located in the Village of Mayfield and identified in Exhibit "A" attached <br />hereto and incorporated herein by reference pursuant to the bids and <br />specifications as advertised by the Village, and pursuant to the company's bid, as <br />received by the Village which was determined to be the best bid, and pursuant to <br />the terms and conditions as set forth in these documents, which shall be <br />maintained by the Director of Finance, in an amount not to exceed $25,000.00. <br />SECTION 2. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at open <br />meetings of this Council; and that deliberations of this Council and of its <br />committees, resulting in such formal action, took place in meetings open to the <br />public, in compliance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the health, safety and welfare of the residents <br />of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the <br />passage by the affirmative vote of not less than five (5) members elected to <br />i } Council and approval by the Mayor or otherwise at the earliest time allowed by <br />law. <br />~• <br />
