ORDINANCE NO. 2004-31 <br />SUBMITTED BY: Initiative Petition <br />AN EMERGENCY ORDINANCE <br />SUBMITTING A PROPOSAL FOR A CHARTER AMENDMENT <br />TO THE ELECTORS RELATIVE TO ELIMINATING THE PROHIBITION <br />AGAINST COUNCIL MEMBERS SERVING MORE THAN <br />THREE CONSECUTIVE TERMS <br />WHEREAS, the Village has received a petition for submission of a <br />proposed amendment to the Charter eliminating the prohibition against the Council <br />Members holding office for more than three consecutive terms; and <br />WHEREAS, the Board of Elections has verified that the petitions and <br />signatures that are thereon are valid and sufficient in number for such issue to be <br />placed on the November 2~d ballot for all electors in the Village of Mayfield; and <br />WHEREAS, pursuant to the Charter of the Village of Mayfield, when a <br />petition is properly submitted, the Council is obligated to transfer same to the <br />Board of Elections for placement on the ballot. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO THAT: <br />SECTION 1. The Clerk of Council is hereby and herein authorized and <br />directed to deliver to the Board of Elections for Cuyahoga County, a certified copy <br />of this Ordinance authorizing a Charter Amendment to be placed on the November <br />2nd ballot for all electors in the Village of Mayfield, pursuant to the petition for a <br />proposed amendment to the Charter, the subject matter of which is attached <br />hereto and incorporated herein as Exhibit "A". <br />SECTION 2. The language appearing on the ballot on November 2, 2004 <br />shall read as follows: <br />PROPOSED CHARTER AMENDMENT BY INITATIVE PETITION <br />(MAJORITY AFFIRMATIVE VOTE REQUIRED) <br />SHALL MAYFIELD VILLAGE CHARTER, ARTICLE <br />III, SECTION 1 BE AMENDED TO ELIMINATE THE <br />PROHIBITION AGAINST HOLDING THE TERM OF <br />OFFICE OF COUNCIL FOR MORE THAN THREE <br />(3) CONSECUTIVE TERMS, EFFECTIVE JANUARY <br />1, 2005? <br /> <br />
