ORDINANCE NO. 2004-41 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING SECTION 337.28 OF THE CODIFIED ORDINANCES OF <br />HAYFIELD VILLAGE REGARDING WINDOW TINTING ON MOTOR VEHICLES <br />WHEREAS, the Director of Public Safety in accordance with Chapter 119 <br />of the Ohio Revised Code recently amended rules relating to the use of <br />sunscreening, nontransparent and reflectorized materials on motor vehicle <br />windows as is set forth in the Ohio Administrative Code Chapter 4501-41; and <br />WHEREAS, it is necessary and in the best interest of the health, safety <br />and welfare of all Village residents to amend Section 337.28 of the Codified <br />Ordinances of Mayfield Village so as to allow enforcement of the Director of Public <br />Safety's most current rule regulating the use of window tinting without amending <br />that ordinance each and every time the rule is changed by the Director. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO THAT: <br />SECTION 1. Current Section 337.28 of the Codified Ordinances of <br />Mayfield Village is repealed in its entirety, and thereafter, amended as follows: <br />337.28 USE OF SUNSCREENING, NONTRANSPARENT <br />AND REFLECTORIZED MATERIALS <br />(a) No person shall operate, on any street or other <br />public or private property open to the public for <br />vehicular travel or parking, nor lease or rent <br />any motor vehicle that is required to be <br />registered in this state with any sunscreening <br />material, or other product or material, which <br />has the effect of making the windshield or <br />windows nontransparent or would alter the <br />windows' color, increase its reflectivity, or <br />reduce its light transmittance unless in <br />conformance with ORC 4513.241, OAC <br />Chapter 4501-41, or any other rule adopted by <br />the Director of Public Safety in accordance with <br />Chapter 119 of the Revised Code. <br />
