t <br />6. Licensee will employ such reasonable measures and take such reasonable action as may be <br />necessary to deter any member of the public using said Premises, to enter on or into Licensor's adjacent or adjoining <br />property. The Licensee may take such action including, but not limited to, arrest and prosecution of such a trespasser. <br />7. Licensee shall not make or begin construction of any improvements, alterations, or modifications <br />to the Premises prior to submitting detailed site plans for its facilities and receiving written approval of Licensor prior to <br />the start of work and shall not commit or suffer waste to be committed upon the Premises. Licensee shall, at its sole <br />cost, keep, patrol and maintain the Premises in a good, neat, safe, clean, and sightly condition, including mowing of the <br />Premises, in a condition reasonably satisfactory to Licensor, reasonably free of all debris, and litter. Licensee shall, at <br />its own cost, comply with all present and future federal, state, and local statutes, ordinances, rules, or regulations and <br />orders pertaining to its use of the Premises. Licensee shall not conduct on the Premises any offensive, noisy, dangerous <br />or illegal business or use or other activity constituting a nuisance. <br />8. Licensee agrees that all work done in connection with the installation and/or construction of roads <br />or facilities within the Premises shall be performed in accordance with accepted engineering practices including, if <br />necessary, cathodic protection, bonding, and/or grounding to eliminate any effect of induced voltage or stray fault <br />currents. <br />9. Licensee acknowledges that a drain the exists on the Premises and is utilized exclusively for the <br />proper drainage of the Premises including Licensor's adjacent property, in accordance with local and state requirements <br />and regulations. Licensee may relocate the fence located on the east side of the property to the immediate east side of <br />the existing curb at Licensee sole expense. Licensee will immediately repair any and all damage of any kind <br />whatsoever resulting from Licensee's use of the Premises. Licensee agrees not to conduct any construction or <br />excavation on the Premises without the prior specific written approval of the Licensor. Licensee shall notify Licensor <br />immediately in writing of any injuries, property damage or claims made by third parties against Licensee. Licensee <br />shall be responsible for all property damage caused by Licensee or its agents, contractors, employees, officers, visitors, <br />invitees, and guests on the Premises. <br />10. Licensee agrees to pay for all utilities used by it, and/or its agents, contractors, employees, <br />visitors, invitees and guests during the term of this License or any renewal thereof. Licensor shall pay all real estate <br />taxes and assessments levied and charged against said Premises except that the amount of any increase in real estate <br />taxes or assessments by reason of improvements located on said Premises by Licensee, shall be paid for by Licensee. <br />2 <br />
