v <br />RESOLUTION NO. 2004-30 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />EXPRESSING OPPOSITION TO THE DRAFT <br />HEALTH CARE PRESERVATION PLAN PROPOSED BY OPERS <br />WHEREAS, OPERS has recently drafted a proposed health care <br />preservation plan ("HCPP") to preserve future healthcare benefits for retirees; and <br />WHEREAS, pursuant to HCPP draft, current retirees and current <br />employees are negatively impacted; and <br />WHEREAS, any and all changes made pursuant to the HCPP should not <br />adversely impact any current retirees or current employees, rather any changes <br />should only be applied prospectively to all new hires. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO THAT: <br />SECTION 1. The Council of the Village of Mayfield wishes to express its <br />opposition to the draft HCPP proposed by OPERS with respect to the reduction of <br />benefits to all current retirees and current employees and urges the OPERS <br />Retirement Board to not approve the draft HCPP to the extent that it provides for a <br />reduction of benefits to all current retirees and current employees. <br />SECTION 2. The Council finds and determines that all formal actions of the <br />Council relating to the adoption of this Resolution have been taken at open <br />meetings of this Council; and that deliberations of this Council and of its <br />committees, resulting in such formal action, took place in meetings open to the <br />public in compliance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the health, safety and <br />welfare of the residents of Mayfield Village. It shall, therefore, take effect <br />immediately upon passage by the affirmative vote of not less than five (5) <br />members elected to Council and approval by the Mayor or otherwise at the earliest <br />time allowed by law.
