f <br />RESOLUTION NO. 95- 28 <br />INTRODUCED BY: <br />A RESOLUTION DECLARING IT NECESSARY TO IMPROVE <br />CERTAIN PROPERTIES IN MAYFIELD VILLAGE BY <br />CONSTRUCTING SANITARY SEWERS, TOGETHER WITH <br />SERVICE CONNECTIONS THEREFOR AND THE NECESSARY <br />A.PPURTENANCES TBERETO, IN WORTON PARK DRIVE, <br />NORTH WOODLANE DRIVE, WOODLANE DRIVE, SOUTH <br />WOODLANE DRIVE AND NORMAN LANE, BETWEEN CERTAIN <br />TERMINI, AND DECLARING AN EMERGENCY. <br />BE IT RESOLVED by the Council of Mayfield Village, Cuyahoga County, Ohio, <br />three-fourths of all members elected or appointed thereto concurring, that: <br />Section 1. It is declared necessary to improve in Mayfield Village the properties <br />described in Section 4 of this resolution by constructing sanitary sewers, together with service <br />connections therefor and the necessary appurtenances thereto, in Worton Park Drive from an <br />existing sanitary sewer in Wilson Mills Road to South Woodlane Drive, in North Woodlane <br />Drive from Worton Park Drive to Woodlane Drive, in Woodlane Drive from North Woodlane <br />Drive to South Woodlane Drive, in South Woodlane Drive from Woodlane Drive easterly <br />approximately 715 feet and from a point approximately 165 feet westerly of Worton Park Drive <br />easterly approximately 355 feet to the terminus of South Woodlane Drive and in Norman Lane <br />from Worton Park Drive to a point approximately 130 feet easterly of Woodlane Drive. <br />Section 2. The plans, specifications, profiles and estimate of cost of the <br />improvement, prepared by Stephen Hovancsek & Associates, Inc., engineering consultants to <br />the Village, and now on file in the office of the Clerk of Council, are approved. The <br />improvement shall be made in accordance with, and the grade of the improvement and of any <br />street shall be the grade as shown on, the plans, specifications and profiles for the improvement. <br />Section 3. This Council finds and determines that (i) the improvement is conducive <br />to the public health, convenience and welfare of this Village and the inhabitants thereof and (ii) <br />the lots and lands to be, assessed as described in Section 4 hereof are specially benefited by the <br />improvement. This Gouncil further finds and determines that this improvement constitutes a <br />continuous sewage collection system improvement and the properties to be improved are so <br />situated in relation to each other that, in order to complete the improvement thereof as herein <br />provided in the-most practical and economical manner, they should be improved at the same <br />time, with the same kind of materials and in the same manner and, therefore, they shall be <br />treated as a single improvement and included in the same legislation and contract. <br />Section 4. The whole cost of the improvement less any grant funds and less 10% <br />of that whole cost, which is hereby determined to be in excess of 2% of that whole cost <br />together with the cost of intersections, shall be assessed in proportion to the benefits that may <br />result from the improvement upon all lots and lands bounding and abutting upon the <br />improvement between the termini described in Section 1 hereof, except lots and lands identified <br />in the Records of the Cuyahoga County Auditor as Permanent Parcel Nos. 831-33-009, <br />831-33-010, 831-33-013 and 831-34-007.
