RESOLUTION NO. 95-34 <br />INTRODUCED BY: MAYOR RINKER AND COUNCIL AS A WHOLE. <br />A RESOLUTION APPROVING THE REPORT OF THE <br />ASSESSMENT EQUALIZATION BOARD ON OBJECTIONS <br />CONCERNING THE ESTIMATED SPECIAL ASSESSMENTS FOR <br />THE IMPROVEMENT OF CERTAIN PROPERTIES IN MAYFIELD <br />VILLAGE BY CONSTRUCTING SANITARY SEWERS, TOGETHER <br />WITH SERVICE CONNECTIONS THEREFOR AND THE <br />NECESSARY APPURTENANCES THERETO, IN WORTON PARK <br />DRIVE, NORTH WOODLANE DRIVE, WOODLANE DRIVE, <br />SOUTH WOODLANE DRIVE AND NORMAN LANE, BETWEEN <br />CERTAIN TERMINI, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Assessment Equalization Board appointed by Resolution No. 95-30, <br />adopted on August 9, 1995, to hear and deternune all objections to the estimated special <br />assessments for the improvement of the properties described in Section 4 of Resolution No. <br />95-28, adopted on June 19, 1995, by constructing sanitary sewers, together with service <br />connections therefor and the necessary appurtenances thereto, in Worton Park Drive from an <br />existing sanitary sewer in Wilson Mills Road to South Woodlane Drive, in North Woodlane <br />Drive from Worton Park Drive to Woodlane Drive, in Woodlane Drive from North Woodlane <br />Drive to South Woodlane Drive, in South Woodlane Drive from Woodlane Drive easterly <br />approximately 715 feet and from a point approximately 165 feet westerly of Worton Park Drive <br />easterly approximately 355 feet to the terminus of South Woodlane Drive and in Norman Lane <br />from Worton Park Drive to a point approximately 130 feet easterly of Woodlane Drive in <br />accordance with law and with that resolution has filed its report with this Council as to its <br />determination of the objections; and <br />WHEREAS, Council has reviewed that report and deems it proper in all respects; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of Mayfield Village, <br />Cuyahoga County, Ohio, that: <br />Section 1. The report of the Assessment Equalization Board referred to in the <br />preambles to this resolution is approved. The estimated special assessments as reported by the <br />Board shall be filed in the office of the Clerk of Council. <br />Section 2. This Council finds and determines that all formal actions of this Council <br />concerning and relating to the adoption of this resolution were adopted in an open meeting of <br />this Council and that all deliberations of this Council and of any of its committees that resulted <br />in those formal actions were in meetings open to the public, in compliance with the law. <br />Section 3. This resolution is declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, health and safety of the Village and for the <br />further reason that this resolution is required to be immediately effective to provide for the <br />construction of the improvement, which is urgently needed to eliminate existing and potential
