RESOLUTION NO. 95-34 INTRODUCED BY: MAYOR RINKER AND COUNCIL AS A WHOLE. A RESOLUTION APPROVING THE REPORT OF THE ASSESSMENT EQUALIZATION BOARD ON OBJECTIONS CONCERNING THE ESTIMATED SPECIAL ASSESSMENTS FOR THE IMPROVEMENT OF CERTAIN PROPERTIES IN MAYFIELD VILLAGE BY CONSTRUCTING SANITARY SEWERS, TOGETHER WITH SERVICE CONNECTIONS THEREFOR AND THE NECESSARY APPURTENANCES THERETO, IN WORTON PARK DRIVE, NORTH WOODLANE DRIVE, WOODLANE DRIVE, SOUTH WOODLANE DRIVE AND NORMAN LANE, BETWEEN CERTAIN TERMINI, AND DECLARING AN EMERGENCY. WHEREAS, the Assessment Equalization Board appointed by Resolution No. 95-30, adopted on August 9, 1995, to hear and deternune all objections to the estimated special assessments for the improvement of the properties described in Section 4 of Resolution No. 95-28, adopted on June 19, 1995, by constructing sanitary sewers, together with service connections therefor and the necessary appurtenances thereto, in Worton Park Drive from an existing sanitary sewer in Wilson Mills Road to South Woodlane Drive, in North Woodlane Drive from Worton Park Drive to Woodlane Drive, in Woodlane Drive from North Woodlane Drive to South Woodlane Drive, in South Woodlane Drive from Woodlane Drive easterly approximately 715 feet and from a point approximately 165 feet westerly of Worton Park Drive easterly approximately 355 feet to the terminus of South Woodlane Drive and in Norman Lane from Worton Park Drive to a point approximately 130 feet easterly of Woodlane Drive in accordance with law and with that resolution has filed its report with this Council as to its determination of the objections; and WHEREAS, Council has reviewed that report and deems it proper in all respects; NOW, THEREFORE, BE IT RESOLVED by the Council of Mayfield Village, Cuyahoga County, Ohio, that: Section 1. The report of the Assessment Equalization Board referred to in the preambles to this resolution is approved. The estimated special assessments as reported by the Board shall be filed in the office of the Clerk of Council. Section 2. This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in those formal actions were in meetings open to the public, in compliance with the law. Section 3. This resolution is declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of the Village and for the further reason that this resolution is required to be immediately effective to provide for the construction of the improvement, which is urgently needed to eliminate existing and potential
