RESOLUTION NO. 95-35 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />AUTHORIZING THE MAYOR TO ENTER INTO A JOINT <br />AGREEMENT WITH CUYAHOGA COUNTY FOR THE PROGRESSIVE/ <br />WILSON MILLS/LANDER ROAD PROJECTS <br />WHEREAS, it has already been determined to be necessary in the <br />best interest of the health, safety and welfare of all of the <br />Village inhabitants to improve the Lander Road intersection, the <br />Wilson Mills Road right turn lane, and the Wilson Mills Road left <br />turn lane; and <br />WHEREAS, the Village Council wishes to authorize the Mayor to <br />enter into a joint venture project with the County of Cuyahoga in <br />order to undertake these improvements. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby authorized and directed <br />to enter into a joint venture agreement with the County of Cuyahoga <br />with regards to the Progress ive/Wil son Mills/Lander Road <br />improvement projects, according to the terms and specifications as <br />set forth in that agreement, which shall be maintained by the <br />Director of Finance. <br />SECTION 2. That the Director of Finance is further authorized <br />to undertake those actions necessary to comply with the joint <br />venture agreement with the County of Cuyahoga with regards to these <br />improvements. <br />SECTION 3. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village. <br />It shall, therefore, take effect immediately upon passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />L <br />MAJ?K FIXL , <br />Council President
