RESOLUTION NO. 95-38 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />A RESOLUTION <br />AUTHORIZING THE DIRECTOR OF LAW TO DISMISS THE <br />CASE OF THE VILLAGE OF MAYFIELD AGAINST THE <br />NORTHEAST OHIO REGIONAL SEWER DISTRICT <br />WHEREAS, the Village of Mayfield had litigation against the <br />Northeast Ohio Regional Sewer District relative to the creation of <br />the interceptors, and the elimination of pump stations and <br />comminutor stations within the Village of Mayfield; and <br />WHEREAS, the interceptors have been created and tied in, and <br />are operational, and the pump stations and comminutor station have <br />been taken out of service. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Director of Law is hereby and herein <br />authorized and directed to cause the dismissal of the case known as <br />Mayfield Villaqe v Northeast Ohio Regional Sewer District, et al., <br />Case No. 168802 pending before the Court of Common Pleas for <br />Cuyahoga County. <br />SECTION 2. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3.
