RESOLUTION NO. 95-41 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />AWARDING THE CONTRACT FOR INSTALLATION OF <br />SANITARY SEWERS FOR THE WORTON PARK SANITARY <br />SEWER IMPROVEMENT <br />WHEREAS, the Village has advertised pursuant to law for bids <br />for the installation of the Worton Park Sanitary Sewer improvement <br />pursuant to specifications prepared by the Village Engineer; and <br />WHEREAS, the lowest and best bid has been determined by <br />Council and the contract for such installation is hereafter <br />awarded. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor and Director of Finance are hereby <br />and herein authorized and directed to enter into an agreement with <br />Marra Constructors, Inc. , as and for the installation <br />of the Worton Park Sanitary Sewer improvement, pursuant to the <br />specifications as established by the Village Engineer. This <br />authorization is conditional upon Marra Constructors znc. obtaining <br />approval, per law, from the Ohio EPA. <br />SECTION 2. The Director of Finance is authorized to make <br />payment for such sanitary sewer improvement installation in an <br />amount not to exceed $ 787, 706.00 <br />SECTION 3. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village. <br />It shall, therefore, take effect immediately upon passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law.
