ORDINANCE NO. 95-03 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT FOR THE PURCHASE OF A 1995 HARLEY DAVID5ON MOTORCYCLE FOR USE BY THE POLICE DEPARTMENT WITHOUT THE NECESSITY OF ADVERTISEMENTS AND FORMAL BIDDING FOR AN AMOUNT NOT TO EXCEED TWELVE THOUSAND DOLLARS ($12,000.00). WHEREAS, Section 735.051 of the Ohio Revised Code provides that in the case of:a real and present emergency arising in connection with the maintenance and operation of any municipal department, the legislative authority may, by two-thirds (2/3) vote of all its members elected thereto, authorize the Mayor to enter into a contract for the immediate improvement of public property without formal bidding and advertising; and WHEREAS, the Village Council previously authorized the Mayor to enter into a lease agreement for the rental of two (2) Harley Davidson Motorcycles for use by the Police Department with an option to buy and the vendor is now willing to provide the Village with a newer vehicle if it exercises the option to purchase; and WHEREAS, the Village Council wishes to exercise the purchase option which has been previously approved through appropriate legislation and to take advantage of the vendor's offer to obtain a new vehicle, and Council further deems this to be a real and present emergency in light of the peculiar circumstances of this original contract, the offer of the vendor, and the savings that would be realized by the taxpayers of the Village, and will therefore forego the necessity of formal advertisement and bidding. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to exercise an option to purchase a 1995 Harley Davidson SLHTP Motorcycle without the necessity of legal advertisement and formal bidding in an amount not to exceed Twelve Thousand Dollars ($12,000.00) as is set forth in the quote submitted to the Village by the vendor which is attached hereto as Exhibit "A" without advertising and formal bidding in that the same is necessitated by a real and present emergency, as outlined in the preamble hereof. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have. been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
