ORDINANCE NO. 95-03 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT FOR THE <br />PURCHASE OF A 1995 HARLEY DAVID5ON MOTORCYCLE FOR USE BY <br />THE POLICE DEPARTMENT WITHOUT THE NECESSITY OF <br />ADVERTISEMENTS AND FORMAL BIDDING FOR AN AMOUNT NOT TO <br />EXCEED TWELVE THOUSAND DOLLARS ($12,000.00). <br />WHEREAS, Section 735.051 of the Ohio Revised Code provides <br />that in the case of:a real and present emergency arising in <br />connection with the maintenance and operation of any municipal <br />department, the legislative authority may, by two-thirds (2/3) vote <br />of all its members elected thereto, authorize the Mayor to enter <br />into a contract for the immediate improvement of public property <br />without formal bidding and advertising; and <br />WHEREAS, the Village Council previously authorized the Mayor <br />to enter into a lease agreement for the rental of two (2) Harley <br />Davidson Motorcycles for use by the Police Department with an <br />option to buy and the vendor is now willing to provide the Village <br />with a newer vehicle if it exercises the option to purchase; and <br />WHEREAS, the Village Council wishes to exercise the purchase <br />option which has been previously approved through appropriate <br />legislation and to take advantage of the vendor's offer to obtain <br />a new vehicle, and Council further deems this to be a real and <br />present emergency in light of the peculiar circumstances of this <br />original contract, the offer of the vendor, and the savings that <br />would be realized by the taxpayers of the Village, and will <br />therefore forego the necessity of formal advertisement and bidding. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to exercise an option to purchase a 1995 Harley Davidson <br />SLHTP Motorcycle without the necessity of legal advertisement and <br />formal bidding in an amount not to exceed Twelve Thousand Dollars <br />($12,000.00) as is set forth in the quote submitted to the Village <br />by the vendor which is attached hereto as Exhibit "A" without <br />advertising and formal bidding in that the same is necessitated by <br />a real and present emergency, as outlined in the preamble hereof. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have. been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />
