ORDINANCE NO. 95-10 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT FOR DEDICATION OF CERTAIN <br />PORTIONS OF BEECHERS BROOK AND NORTH AINTREE <br />WHEREAS, the Village is desirous of obtaining certain <br />privately owned portions of Beechers Brook and North Aintree so as <br />to dedicate same to public use; and <br />WHEREAS, the area to be dedicated is set forth in the <br />agreement attached hereto and incorporated herein as Exhibit "A"; <br />and <br />WHEREAS, the plat indicating the area to be dedicated to <br />public use is attached hereto and incorporated herein as Exhibit <br />nBn~ <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into an agreement with Richard A. Siracusa as and <br />for the dedication of the area set forth in the legal description <br />attached to Exhibit "A", incorporated herein by reference. <br />SECTION 2. The Mayor and the Village are also authorized to <br />accept this dedication, and to cause the amended plat reflecting <br />same to be recorded as required by law. Said plat being attached <br />hereto and incorporated herein as Exhibit "B". <br />SECTION 3. In consideration of the dedication of this <br />property, the Village is hereby and herein authorized to provide <br />the property owner a waiver as to all application fees, permit <br />fees, and inspection fees and deposits as required by the Village <br />for the construction of a single family dwelling on the property <br />owned by Richard A. Siracusa and known as Permanent Parcel No. 831- <br />36-025. <br />SECTION 4. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory .requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 5. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />
