-- ORDINANCE NO. 95- 23 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING SECTION 351.99, RELATIVE TO THE <br />PENALTY FOR ILLEGAL PARKING IN A FIRE LANE <br />WHEREAS, there have been complaints of numerous violations of <br />the ordinance against parking in a fire lane; and <br />WHEREAS, it is the intention of Council to increase the <br />penalties for such violations. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 351.99 of the Codified Ordinances is <br />hereby and herein amended, in Subsections (a) and (b), as follows: <br />351.99 PENALTY. <br />(a) Whoever violates Section 351.03(d), (i), or (q) e~ <br />-(~-} shall be fined ten dollars ($10.00) if such fine is paid <br />within forty-eight hours after such violation; a violation of <br />Section 351 031s) shall be fined forty dollars (540.00) within <br />the same time frame. <br />-, (b) Whoever violates Section 351.03(d), (i), or (q) ~ <br />__. -{-s)- shall be fined twenty dollars ($20.00) if such fine is <br />paid after forty-eight hours and before seventy-two hours <br />after such violation; a violation of Section 351.03(s) shall <br />be fined fifty dollars (S50 00) within the same time frame. <br /> <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately- upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. ~n~ l~ <br />lX-~ <br />-p~~-F~LE~ ALLACE J.
