ORDINANCE NO. 1995-24 (As amended) INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE ESTABLISHING A "SEWER RELIEF FUND" WHEREAS, many of the Village residents are facing, or will face in the future, a significant financial impact as a result of the necessity created by state and federal environmental protection laws to install and/or improve sanitary sewer systems throughout the Village; WHEREAS, it is the desire and intent of the Village to establish a special fund, as and for the purpose of assisting those citizens throughout the Village facing such mandatory sewer improvements. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That there is hereby and herein established a "Sewer Relief Fund" within the Village of Mayfield. Such a fund shall have funds appropriated into it as determined by Council. Such fund shall be exclusively used for the benefit of the property owners in the Village of Mayfield who are incurring the financial burden of sanitary sewer construction and improvements. SECTION 2. The Village will and does hereby authorize the transfer of $100,000 this fiscal year into the "Sewer Relief Fund" from the General Fund. SECTION 3. It is the desire of this Mayor and Council, and their intent to appropriate such amount into the Sewer Relief Fund for a total of twenty (20) years, and all successor Mayors and Councils are urged to abide by this ordinance and continue the fulfillment of this intention. SECTION 4. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 5. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, and for the further reasons set forth in the preamble hereof. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law. _ _ (4)
